Conveyancing
As described in the Buying a Property section, conveyancing is required for all property sales and purchases in Scotland. In a property sale, the process involves transferring the title of your property from you (the seller) to the purchaser. Numerous communications between Peterkins (the selling solicitor) and the purchasing solicitor will take place to complete this process.
Peterkins will handle all contractual and conveyancing matters for your sale. Initially, you will receive a note or notes of interest in your property from prospective purchasers. Offers will then be received, which you can accept, reject, or negotiate. We will provide expert advice on any offers received and handle the acceptance, rejection, or negotiation on your behalf. When an acceptable written offer is received, we will write a qualified acceptance on your behalf. The aim is to conclude missives, which is the contract for the sale of the property. The sale becomes legally binding on both parties only when the missives have been concluded.
We will then send the title deeds for your property to the purchaser’s agent for detailed examination to ensure the title being offered is acceptable. The Disposition, signed by you as the seller, transfers ownership of the property to the buyer.
